Facing a DUI charge in South Carolina is not something a person should do alone.
South Carolina Code of Laws Section 56-5-2930 reads:
It is unlawful for a person to drive a motor vehicle within this State while under the influence of alcohol to the extent that the person's faculties to drive a motor vehicle are materially impaired, under the influence of any other drug or a combination of other drugs or substances which cause impairment to the extent that the person's faculties to drive a motor vehicle are materially impaired, or under the combined influence of alcohol and any other drug or drugs or substances which cause impairment to the extent that the person's faculties to drive a motor vehicle are materially impaired.
There are any number of issues to look at with a DUI charge – did law enforcement have probable cause, did you provide a breath or blood sample, field sobriety tests, and were you even driving.
Were you under the influence or alcohol, drugs, an intoxicating substance, or a combination of any of these? Notice that the law doesn't say illegal drugs. Under the influence of sleep medication can be grounds so long as you are impaired.
Field sobriety tests are employed by law enforcement to provide indicators of material impairment. Were these tests administered properly? Do other factors exist that would prevent you from properly performing the field sobriety tests?
In addition to the criminal side of the case, there is the administrative side. What is the status of your driver’s license? Was there implied consent? Did you refuse to give a breath or blood sample and how does that affect your license? What is the status of license if you did give a breath or blood sample? Do you need a temporary license? Provisional license? Will you be required to use an ignition interlock device?
